Bombay High Court upholds PPL’s authority in landmark copyright battle

In a historic ruling on January 24, 2024, the Bombay High Court has delivered a decisive victory for music licensing giants Phonographic Performance Ltd. (PPL) and Novex Communications Pvt. Ltd., affirming their authority to issue licenses as copyright owners without the need for registration as copyright societies. This groundbreaking judgment settles a prolonged debate on owner rights in licensing sound recordings.

The court’s order has far-reaching implications for the music industry, as PPL, founded in 1941, emerges victorious in multiple suits against over 200 establishments, including popular names like Social, Farzi Café, and Olive Bar & Kitchen. G.B. Aayeer, CEO of PPL, hails the verdict as not just a win for the company but a triumph for the entire music industry, emphasizing the protection of creative endeavors and the valuation of artists and copyrights.

Key findings of the court include the affirmation of PPL’s status as the owner and exclusive licensee, granting it the power to issue licenses under Section 30, and validating assignment deeds and exclusive license agreements. This legal triumph empowers PPL to continue its licensing operations unimpeded, safeguarding its vast catalog of over 70 lakh songs from renowned labels.
